The object of these general conditions is the purchase of products made remotely through a website. Any purchase is reserved for direct customers excluding traders, wholesalers, retailers, professionals, etc. who intend to resell the products to third parties. Each transaction will be regulated by the Legislative Decree number 185/99 (implementation of directive 97/7/ec on consumers’ protection concerned with distance contracts). As for the protection of confidentiality and personal data, we follow the legislation set out by the Legislative Decree no. 196 set out on the 30th of June 2003 (single text on the confidentiality of data) and subsequent amendments.
2. Acceptance of the general conditions of sale
The customer, by sending telematic confirmation of his purchase order, fully accepts the general conditions and payment terms explained in www.panicoguitars.com. Declaring that he has read and has therefore accepted all information provided to him. Also, noting that PANICO CUSTOM INSTRUMENTS founded by Panico Luca does not consider itself bound to different conditions unless previously agreed in writing.
3. How to purchase from the shop
www.panicoguitars.com is a telematics website that sells music products. Purchases, as illustrated and described online in the relevant descriptive and technical sheets, are made by the customer at the price indicated on the website. Once the order is confirmed the costumer will receive a confirmation email where transport costs will be added. Before the confirmation is sent out, the customer will receive a summary of the unit cost of each product chosen, the total cost (where more than one product has been purchased) and the related transport costs. Once the buyer agrees to proceed and confirms the order, upon completion of the transaction, the customer will receive an e-mail message containing the date, total amount of his order and the details of the latter.
4. How to purchase a commissioned instrument
To commission an instrument with personal characteristics, simply send an email with the description and characteristics of the model you have chosen in reference to the price list on the site or fill out the form in the “let’s build your guitar” section.
A quote will be sent with the specifications of the instrument, the price, the timing of implementation and a preview image of the configured instrument.
The confirmation of the estimate can take place in three ways:
-Payment of 50% of the total budgeted to start the work and the balance will take place at the end of the instrument
-Payment of 20% of the total budgeted to start the work and the balance will take place in 4 installments without additional costs with deadlines of 30-60-90 days from confirmation and 4th installment in pay at the end of the instrument.
-Payment of 20% of the total budgeted to start the work and the balance will be in 6 installments without additional costs with deadlines at 30-60-90-120-150 days from confirmation and 6th installment in pay at the end of the instrument. Non-refundable advance amount.
If purchased in installments, the buyer must pay the installment amounts no later than the deadline indicated in the estimate.
At the end of the instrument, the customer will have to pay the balance installment.
After receiving the online credit notification of the balance within a few working days we will prepare the instrument for shipment.
The courier’s tracking code will be sent at the time of shipment.
In case of default, the production process will be blocked. The instrument will be held in delivery without proceeding with the progress of the work for a maximum of 30 days from the last unpaid installment. During this time, the customer has the opportunity to pay off the debt.
The buyer must pay both the unpaid installment and the subsequent installment.
The expected delivery of the instrument will be postponed in days equal to the payment delay.
If after the aforementioned period the debt is not paid, the order will be considered canceled and the customer will lose the opportunity to redeem the instrument and the installments paid up to now.
Panico Guitars will then be able to sell the instrument to the public.
5. Right of withdrawal
In case of an unsatisfied customer who does not wish to replace the items (or receive a voucher of equal value) it is possible to appeal to the RIGHT OF WITHDRAWAL within 14 working days of receipt of the product as stated by the current legislation (n. 185 of 22/05/1999). In case of return and subsequent refund Panico Custom Instruments reserves the right to subtract the following expenses:
- Shipping costs of the original order (even in case of free shipping).
- Handling costs equal to 10% of the value of the returned item(s).
- Shipping costs to cover the return of the item(s) are charged to the costumer whom must return the products through the same shipping system that was used to send it out in the first place. In alternative, he can also make arrangements with Panico Custom Instruments to have the collection organized directly by them.Arrangements for the return will start only after receiving the shipping costs of 20 € by bank transfer.The refund will be issued within 20 working days upon arrival of the returned item(s) and only after the integrity of the equipment has been verified.
If the item(s) has been damaged or tampered with in any way, no refund will be issued and the instrument will be returned to the buyer after payment and receipt of the shipping costs of 20€ by bank transfer (this also applies to a replacement with another product).
To request a return with refund, and exercise the right of withdrawal, you must write to our email address (see contact page), specifying “Return with refund” as a subject. Shortly after we will send you instructions how to return your order. In your email you must specify:
- Personal data: Name, Surname, Email and Phone number
- Order number of product(s) to be returned
- Model and serial number(s) of the instrument(s)
- Reason for returning the product(s)
- IBAN and account holder of where you would like the refund
Once we have received and verified your request, we will contact you to provide you with instructions on how to make the return. Warning: do not send the products without first receiving a confirmation in response to the email you sent. Once the product has been returned and verified you will subsequently receive a refund to your bank account within 20 days from the date of return of the items.
6. Information and complaints
For any information and/or complaints, you can reach out to Panico Custom Instruments founded by Panico Luca via e-mail (see contact page). Any contract will be regulated by Italian law. For any dispute concerning the validity, interpretation or execution of the contract, the territorial jurisdiction of the place of residence or domicile of the consumer is to be considered, if the costumer is located in the state. Article 7 of the Legislative Decree no. 196 from the 30 June 2003 – right of access to personal data and other rights 1. the people involved in the contract has the right to be made aware of the existence of personal data concerning him, even if not yet recorded, and their communication in an intelligible form; 2. the interested party has the right to be informed: a) of the origin of personal data; b) of the purposes and methods of processing; c) of the logic applied in case of processing carried out with the aid of electronic instruments; d) of the identification data concerning data controller, data processors and the representative designated pursuant to art. 5, paragraph 2); e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing; 3. the interested party has the right to obtain: a) the updating, rectification or, when interested therein, integration of the data; b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which they were collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected; 4. the data subject has the right to object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or carrying out market or commercial communication surveys. Upon confirmation of the order, the customer acknowledges that he/she has read all terms and conditions indicated in the various sections (i.e., payment methods, shipping costs, contacts, about us etc.), and accepts all the terms that have been set out.
1- The official warranty is valid for two years from the date of delivery. In the case of used instruments that have been sold, examined and / or refurbished by us, the warranty is one year if the customer is the last owner.
2- The official warranty is excluded in case of damage due to improper or non-compliant use of the products, such as, by way of example, in the following cases:
– insufficient care and maintenance of products; use of unsuitable cleaning products
– modifications of the body and neck (such as holes, milling and painting);
– assembly of additional components or replacement of our components with unauthorized ones or in any case not equivalent or compatible with the originals
3- If it is necessary to replace body and neck, we will replace them with components of the same color and material as the originals, without any exception. This will happen only after our analysis on the product. The replaced Neck or body will be held in company and will not be delivered to the customer. For models that are no longer in the price list, a cost to be incurred will be indicated
If the pickup or hardware needs to be replaced, we will use products of the same type and color, subject to availability in stock.
If over time they have changed in hardware production or structural changes and if no longer in stock, the cost to be incurred will be indicated.
4- The operations included in the warranty do not include additional costs (such as transport costs for return and delivery) and any assembly costs for components necessary following a change in the product models that occurred in the meantime.
5- Interventions carried out by personnel or companies not authorized by us or in any case not commercially linked to us totally invalidate the guarantee, without any exclusion.
6- Our official guarantee is valid and effective only for our customer, the first purchaser of the product.
